记者昨天(21日)从市场监管总局获悉,市场监管总局联合教育部、工业和信息化部、农业农村部、商务部、国家卫生健康委印发《关于加强预制菜食品安全监管 促进产业高质量发展的通知》,首次在国家层面明确预制菜范围,对预制菜原辅料、预加工工艺等进行界定。要点如下:

什么是预制菜?

预制菜也称预制菜肴,是以一种或多种食用农产品及其制品为原料,使用或不使用调味料等辅料,不添加防腐剂,经工业化预加工(如搅拌、腌制、滚揉、成型、炒、炸、烤、煮、蒸等)制成,配以或不配以调味料包,符合产品标签标明的贮存、运输及销售条件,加热或熟制后方可食用的预包装菜肴。

哪些食品不属于预制菜?

从菜肴属性看——

  • 仅经清洗、去皮、分切等简单加工未经烹制的净菜类食品,属于食用农产品,不属于预制菜。
  • 速冻面米食品、方便食品、盒饭、盖浇饭、馒头、糕点、肉夹馍、面包、汉堡、三明治、比萨等主食类产品不属于预制菜。

此外,连锁餐饮企业广泛应用中央厨房模式,其自行制作并向自有门店配送的净菜、半成品、成品菜肴,应当符合餐饮食品安全的法律法规和标准要求。中央厨房制作的菜肴,不纳入预制菜范围。

预制菜定义中强调“加热”或“熟制”后方可食用——

  • 加热是指将食品加热到可食用状态的过程,即针对已经预加工熟制的产品在食用前的简单复热。
  • 熟制是指经炒、炸、烤、煮、蒸等将食品熟制的过程,即在预加工阶段并未完全熟制,需要彻底熟制后方可食用。

不经加热或者熟制就可食用的即食食品及可直接食用的蔬菜(水果)沙拉等凉拌菜不属于预制菜。

如何加强预制菜食品安全监管?

  • 严格落实主体责任。督促预制菜生产经营企业按照《企业落实食品安全主体责任监督管理规定》要求,建立健全食品安全管理制度,加强食品生产经营风险管控,严把原料质量关,依法查验食用农产品原料的承诺达标合格证等产品质量合格证明,严格食品添加剂使用。
  • 加强生产许可管理。修订完善相关食品生产许可审查细则,提高预制菜行业准入门槛。各地市场监管部门要结合食品原料、工艺等因素对预制菜实施分类许可,严格许可审查和现场核查,严把预制菜生产许可关口。
  • 加大监督检查力度。重点检查预制菜生产经营企业进货查验、生产过程控制、贮藏运输等环节质量安全措施落实情况,对检查发现的问题,要责令整改到位,形成监管闭环。组织开展预制菜监督抽检和风险监测,严厉打击违法违规行为。

大力推广餐饮环节使用预制菜明示

《中华人民共和国消费者权益保护法》第八条规定,消费者享有知悉其购买、使用的商品或者接受的服务的真实情况的权利。

目前消费者普遍关注餐饮环节预制菜使用情况,《通知》要求,各有关部门要统筹发展和安全,督促食品生产经营企业按照预制菜原辅料、加工工艺、产品范围、贮藏运输、食用方式等要求从事预制菜生产经营活动。大力推广餐饮环节使用预制菜明示,保障消费者的知情权和选择权。

规定预制菜不添加防腐剂有何考虑?

市场监管总局相关司局负责人就《通知》有关情况答记者问时表示——

  • 预制菜虽经过工业化预制,但仍属于菜肴范畴,消费者在菜肴烹制过程中一般不添加防腐剂,规定预制菜中不添加防腐剂更加符合消费者期待。
  • 食品添加剂“非必要不添加”“在达到预期效果的前提下尽可能降低食品添加剂在食品中的使用量”已经逐步成为行业共识。预制菜通过冷冻、冷藏等贮存条件和杀菌后处理工艺,无使用防腐剂技术必要性。
  • 不添加防腐剂符合预制菜风险管控要求。预制菜在生产、贮存、运输、销售过程中,对环境、温度、湿度、光照等有较高要求,应当加强全链条食品安全风险管控,不同类别预制菜应严格符合相应的冷冻冷藏等条件要求,以保障食品安全。
