Recently, the reporter learned from the Minhang District People's Procuratorate of Shanghai Municipality about a case of manufacturing and selling fake "amiibo" game cards, in which the defendants Feng Moumou, Zhu Moumou and Zeng Moumou were sentenced by the court to fixed-term imprisonment ranging from 1 to 3 years for the crime of counterfeiting registered trademarks.

Xiao Shen is a player in the game "Gathering Animal Crossing". In July 2022, when Xiao Shen was browsing online, he found that the cards sold in a certain store were cheap and sold well, so he ordered 2 sets of game cards through two e-commerce platforms. After receiving the game card, Xiao Shen found that the card he bought this time was rough and inconsistent with the official genuine product, suspected that it was pirated, and reported it to the police station.

According to the name of the store provided by Xiao Shen, the police handling the case seized more than 60,000 counterfeit Nintendo brand game cards, more than 3,000 packaging boxes and 4 burners from Zhu's place of business. By the time the case came to light, the counterfeiting gang had sold more than 1.4 million yuan.

Zhu Moumou confessed that he was unemployed at home in 2021, recalling that he had bought counterfeit game cards marked with the "amiibo" trademark when playing games before, and felt that it was a way to make money, so he repeatedly watched the tutorials uploaded by the "up masters" to learn how to write game data to a blank IC card through the burner. After completing his studies, Zhu Moumou purchased a large number of blank IC cards, wrote data to burn game cards by himself, and sold them through e-commerce platforms, and his girlfriend Feng Moumou assisted in shipping them on weekends.

In the process of making and selling cards, Feng Moumou and Zhu Moumou found that game cards marked with the trademark "amiibo" sold more significantly on an e-commerce platform. So in October 2021, in order to expand revenue, Feng opened online stores on 2 e-commerce platforms, mainly selling Nintendo game cards marked with the "amiibo" trademark. Among them, Feng Moumou is responsible for store operation and delivery, Zhu Moumou is responsible for purchase, and the two also hired Zeng Moumou to help operate two online stores, and the business scope mainly includes game cards for Nintendo games such as "Gathering Animal Forest" and "The Legend of Zelda: Breath of the Wild" that 3 people burned by themselves.

In view of the fact that all three voluntarily admitted guilt and accepted punishment and withdrew their illegal gains, the Minhang Procuratorate initiated a public prosecution, and the three were finally sentenced to the aforementioned punishments.
