Previously, Ding Moumou was arrested by the public security organs for using electric fish in the forbidden fishing area of the Chishui River section of Xu Clan Ancestral Hall in Jiuzhi Town, Hejiang County. The Hejiang County People's Procuratorate filed a criminal attached civil public interest lawsuit with the Hejiang County People's Court in accordance with law. After trial, the court sentenced defendant Ding X to two months' detention and two months' probation for the crime of illegal fishing of aquatic products, confiscated the tools of the crime, and ordered the defendant to increase and release the waters of the Chishui River to restore the ecology.
On October 23, 2019, when reporting to the National People's Congress on the development of public interest litigation procuratorial work, the Supreme People's Procuratorate mentioned: "The procuratorial organs of the four provinces and cities of Chongqing, Sichuan, Yunnan, and Guizhou have established a cross-regional ecological environmental protection procuratorial coordination mechanism in the Chishui River and Wujiang River basins. A winery in Gulin County, Sichuan Province, illegally discharged sewage into the Chishui River, the procuratorate of Xishui County, neighboring Guizhou Province, transferred case clues to the procuratorate of Gulin County, and the procuratorate of Gulin County made procuratorial suggestions to the county ecological and environmental bureau to jointly protect the ecological safety of the river at the border between the two provinces. ”
Chinese barbed catfish is one of the rare and endemic indigenous fish in the upper reaches of the Yangtze River, commonly known as Qingbo, Black Scale and Green Plate. Its body is long and flattened, the head is conical, the snout is blunt, and it prefers to inhabit the rapids of the river beach with clear water quality and the bottom layer is mostly rocky, mainly distributed in the dry and tributaries of the upper reaches of the Yangtze River.
"Prosecutors told me that fishing during the fishing ban period is illegal and destroys the natural ecology of the Chishui River. I now regret my actions and hope that releasing these fry will make up for my mistakes. Ding Moumou said during the release.
Chishui River is the only first-class tributary of the upper reaches of the Yangtze River that has not been dammed in the main stream, and there are 141 species of fish, including 46 species of rare and endemic fish in the upper reaches of the Yangtze River, which is an important habitat for China's fishery resources, a freshwater fish germplasm gene bank, and the only refuge for the survival and reproduction of rare and endemic fish in the upper reaches of the Yangtze River. The implementation of a total ban on fishing in the Chishui River Basin (all natural waters in the Chishui River Basin above the mouth of the Chishui River in Hejiang County) can curb the decline trend of fish resources in the Yangtze River Basin, and is of great significance to the conservation of aquatic biological resources of the Yangtze River, the protection of the ecological environment of the waters, and the realization of sustainable development of fisheries.
In October 2018, since the procuratorial organs of Luzhou City, Sichuan Province and Zunyi City, Guizhou Province, jointly launched the Judicial Protection Assistance Mechanism for the Chishui River Basin, the two sides have jointly carried out the "Special Supervision Activity to Combat the Illegal Crimes of Damaging Environmental Resources in the Chishui River Basin", and the procuratorial organs of the two places have transferred 9 clues to public interest litigation cases involving the ecological and environmental protection of the Chishui River, issued 3 procuratorial suggestions for public interest litigation, and rectified the relevant acts that damaged the ecological environment of the Chishui River.
