Recently, the traffic police in many places have carried out night inspection and rectification operations and found a number of traffic violations of "driving without a license", and the reason for "driving without a license" is not because the owner has not obtained a driver's license, but because of the following two situations.
Licensed or unlicensed driving
The Traffic Safety Law defines "driving without a license" in two ways:
1) Have not obtained a motor vehicle driver's license issued by the mainland public security traffic management department
2) Driving a motor vehicle on the road during the period when the driver's license has been cancelled or revoked
The first good understanding is to drive on the road without obtaining a driver's license, typical of "unlicensed";
The second literally means that the driver's license is revoked or revoked.
There are many kinds of situations in which the driver's license is revoked and cancelled, and below we focus on the most common and the two most easily recruited by the owner.
Late renewal of driver's license
Not surprisingly (there is no record of 12 points in the cycle), the renewal cycle of the driver's license is 6 years - 10 years - long-term, as long as you expire the license. But many car owners still forget to renew their certificates when they expire.
There are three common situations in which a driver's license expires, namely:
1) Expired within 1 year: the certificate can be renewed normally, but if you are caught driving on the road, you will be fined 200 to 500 or less for the behavior of "not participating in the examination after the deadline".
2) Expired 1 year less than 3 years: The driver's license is in the state of "cancellation can be restored", take the subject one examination, and after passing the examination, you can go through the renewal procedures. However, driving on the road during this time will be considered unlicensed driving, and the insurance company will not settle the claim after the traffic accident.
3) Expired for more than 3 years: The driver's license will be cancelled and the driver will need to re-obtain the driver's license.
In the 3 cases, when driving on the road in the 2nd and 3rd cases, the traffic police will judge it as "driving without a license", that is, "the driver's license is more than 1 year overdue". At this time, if the owner of the car is caught driving on the road, it is proper to drive without a license.
Therefore, here is a reminder to everyone: open your driver's license, look at your own renewal time, and don't forget to renew your license.
Driver's license was withheld
According to the law, driving a car while the driver's license is suspended is also considered unlicensed driving.
At present, the main reasons for the detention of driver's licenses are: driver's licenses have been deducted 12 points, drunk driving, drunk driving and other serious traffic violations. If your driver's license is detained by the traffic police or is in a "detained state", do not drive on the road, otherwise you will be arrested.
According to the regulations, driving without a license will face a fine of 200 yuan - 2000 yuan - and can be detained for up to 15 days.
The following situations do not count as driving without a license
In life, many "seemingly" unlicensed driving behaviors are actually not unlicensed driving, and there are the following specific types:
01 Driving is not a quasi-driving type, not driving without a license
Driving non-quasi-driving types is "driving models that do not match the quasi-driving type".
Although it is not unlicensed driving, the penalty is not light, and 9 points are deducted at a time according to the new scoring rules. So, whatever certificate you get, drive what car you want.

02 Forget to bring your driver's license, it is not unlicensed driving
If you have a driver's license, but forget to bring, it is not considered to be driving without a license, at most it is "forgetting to bring a license". But only if you get your driver's license.
At present, the country has fully implemented the electronic driver's license, and everyone can show the electronic driver's license when facing the routine inspection of the traffic police. Therefore, the situation of forgetting to bring a certificate is almost no longer there.
