What is a finished dwelling?

How to ensure the quality of decoration?

Article 1 In order to promote the healthy development of the real estate market in our city, standardize the interior decoration behavior of newly built finished residential buildings, and protect the legitimate rights and interests of the right holders, these Measures are formulated in accordance with the Regulations on the Quality Management of Construction Projects and the Measures for the Administration of the Sales of Commercial Housing.

Article 2 The finished residential building referred to in these Measures refers to the residential building that has basic use functions by paving or painting the fixed surface of all functional spaces in the suite, installing pipelines and terminals, and basic facilities such as kitchen and bathroom before the residential building is delivered for use.

Article 3 These Measures shall apply to the management of newly built finished residential interior decoration projects within the main urban areas of this City (Gulou, Yunlong and Quanshan Districts). Other counties (cities) and districts of the city may refer to the implementation.

Article 4 For projects that are agreed in the purchase contract for the construction of finished houses, their interior decoration projects shall be included in the capital construction procedures of the construction project.

Article 5 In principle, the construction unit shall handle the quality supervision and construction permit formalities for finished residential construction projects and interior decoration projects at one time before the start of construction; for projects that fail to submit for approval and construction permits simultaneously with civil engineering projects due to the lag in decoration design, they may postpone the submission of the decoration engineering drawings for examination, but shall obtain the decoration construction permit for the project at the latest before applying for the pre-sale permit.

Article 6 Units engaged in the design, construction, supervision and other units of finished residential interior decoration shall obtain corresponding qualifications in accordance with law.

Article 7 The construction unit is the primary responsible person for the interior decoration quality of the finished residential building, and is responsible for the overall responsibility for the quality of the finished residential interior decoration, and is specifically responsible for the quality management, quality warranty, after-sales service of the finished residential interior decoration, and organizing the relevant responsible units to coordinate and deal with the quality problems of the project. Encourage construction units to purchase insurance for potential defects in the quality of finished residential projects, implement the early intervention management of property service enterprises, and innovate the quality management and recovery mechanism of decoration.

The design unit shall strictly follow the provisions of relevant laws and regulations, carry out the full decoration design in accordance with the engineering construction standards and the provisions of the contract, and be responsible for the design quality.

The construction unit shall strictly follow the provisions of relevant laws and regulations, carry out the full decoration construction in accordance with the construction drawing design documents, construction technical standards and contracts, and be responsible for the construction quality and safety.

The supervision unit shall strictly follow the provisions of relevant laws and regulations and the relevant technical standards, construction drawing design documents and contracts, adopt the forms of side stations, inspections and parallel inspections to implement the supervision of the whole decoration, and assume the responsibility for supervision of the quality of the project. The supervision institution shall, according to the characteristics of the finished residential decoration, compile the implementation rules for special supervision and organize the implementation.

Article 8 The general contracting system for the interior decoration of finished residential buildings shall be implemented, and the construction unit shall not dismember the decoration project and issue contracts. The general contractor of the construction may construct the finished residential decoration project by itself, and may also carry out professional subcontracting of the decoration project with the consent of the construction unit in accordance with the contract. The general contractor of construction is responsible for the construction quality of the decoration project.

Article 9 Construction units are encouraged to be market-oriented, reasonably formulate decoration standards in response to differentiated consumer needs, provide fully renovated finished residences of different grades and styles, promote standardization and personalized coordination, and better meet the individual needs of owners.

Article 10 The construction and decoration of finished residential buildings should implement integrated design, strengthen the interconnection between professional design and decoration design such as buildings, structures, equipment pipelines, etc., and realize the synchronous design of fixed surfaces, equipment pipelines, switch sockets and basic facilities.

The decoration project shall be specially designed, the performance indicators of the main materials and parts shall be clarified, and large sample drawings and node detailed drawings shall be issued. The review body shall strictly perform the duties of reviewing drawings, focusing on the structural safety, use safety and use function issues involved in the decoration and decoration design documents. After the construction drawings have passed the examination, major design changes shall be submitted to the examination drawing agency for re-examination.

When the construction unit submits the construction drawing design documents for review, the relevant information such as the residential building, unit, and building area of which the decoration is carried out should be clearly stated in the general design description.

Article 11 For finished residential buildings under the pre-sale system, the construction unit shall, before filing the price of commercial housing, make a list of the main materials, structural accessories, equipment, etc. of the basic decoration standards, including information such as name, brand, specification, model, grade, and place of origin. The list is used as an attachment material to the construction drawing design document, and the main material product can provide 1 to 3 product catalog lists in the same grade.

Article 12 The construction unit shall provide the full decoration construction drawings designed according to the standard design plan for each apartment type, and the list of materials attached to the full decoration construction drawings that have passed the drawing examination shall be announced at the pre-sale site.

Article 13 If the decoration design change that does not involve changing the main structure of the project or the use function is not pre-sold, the original design unit shall issue a design change notice and hand it over to the construction unit for implementation. Before the construction unit goes through the formalities for filing the price of commercial housing, the list of materials after the change is published at the pre-sale site; if it has been pre-sold, it shall inform the purchaser according to the provisions of the sales contract, and shall obtain the written consent of all purchasers before the change can be made, and handle it in accordance with the prescribed procedures.

Major renovation design changes such as changes to the main structure, load-bearing structure and important use functions (such as energy saving, waterproofing, etc.) shall be sent to the original construction drawing review body for review.

Article 14 Before the pre-sale of finished residential buildings, a model set of physical products shall be made for delivery. Before the construction of the finished residential full decoration project, a model set of construction process should be made on site. The construction unit shall implement the construction process model and the construction entity model according to the design documents and construction technical standards.

Delivery entity model set refers to the design documents and sales contract as stipulated in the materials, structural accessories and construction process decoration completed by the model set, for all decoration delivery standards consistent set, you can choose the typical apartment type to make a model set, the decoration standards of different sets should be made of different model sets.

The construction process model room (set) refers to the key parts and key process site entities in the decoration project according to the materials and structural accessories specified in the design documents, and the number of model rooms (sets) showing the main construction processes and processes should be controlled in accordance with the principle of showing the main construction processes in each sub-project of the project.

For finished houses that adopt the pre-sale model, a physical model set of delivery should be set up in the available housing. The model set should truly reflect the apartment type, structural size, decoration standards, etc., and shall not increase other decorations and arrangements other than the delivery standards.

Article 15 During the construction, testing and testing shall be strengthened, and after the indoor environmental pollutant concentration test of the delivered entity model set is qualified, the construction unit shall organize the design, construction and supervision units to carry out acceptance, and only after passing the acceptance can the comprehensive decoration and construction be carried out. Each responsible entity should focus on checking whether the entity delivery model complies with the design documents and relevant technical standards, and form a written acceptance opinion.

Article 16 The model set of the delivered entity that has passed the acceptance test shall be used as the standard and basis for the sales and delivery of the house by the construction unit, and the supervision unit shall seal and retain the main materials such as flooring, sanitary ware, etc., and the sample set shall be dismantled only 30 days after the actual delivery date of the last batch.

Article 17 Implement the system of on-site information disclosure and publicity of finished residential commercial housing sales, and the content and method of publicity shall specifically implement the relevant provisions in the Notice on Printing and Distributing the Implementation Plan for the Pilot Work of Publicizing Quality Information on Residential Projects in Xuzhou City (XuZhuJianfa [2021] No. 200). The construction unit is responsible for the authenticity of the publicized information.

Article 18 Before signing the "Contract for the Sale and Purchase of Commercial Housing" with the buyer, the construction unit shall show the buyer the standard and quality of the finished product of the physical model set.

Article 19 The construction unit shall sign a decoration contract with the buyer, specify in the contract the name, brand, specification, model, grade, etc. of the main decoration materials used, and shall not use vague expressions such as "advanced", "high quality" and "brand of the same grade";

Article 20 The construction unit shall ensure that the same process, construction method, materials and structural accessories are adopted for the decoration construction and the delivery of the physical model set, and its quality standards shall not be lower than the quality standards of the model set.

Article 21 Before the construction of finished residential decoration, the construction unit shall organize the construction, supervision and other relevant responsible entity units to carry out "handover acceptance" according to the inspection batch, check and accept the quality of the project entity, and during the acceptance, it shall focus on the investigation of common quality problems such as cracking and leakage, clarify the responsibility, and form a handover acceptance record. The responsible unit shall rectify the problems found in the inspection, and only after the rectification is completed can the decoration and decoration project be carried out.

Article 22 Finished residential decoration projects shall select materials and parts in strict accordance with the design documents, and the materials and parts shall have quality certification documents such as certificates of conformity and performance testing reports, and the quality certification documents shall be true and effective and traceable. The varieties, specifications, quality and limits of harmful substances used in the parts and materials used shall comply with the design requirements and the provisions of the relevant standards of the state in force, and it is strictly forbidden to use the parts and materials that the state has explicitly eliminated.

The construction unit and the supervision unit shall, in accordance with the provisions, inspect the materials and parts entering the site, consult the original quality certification documents and carry out witness sampling and re-inspection in accordance with the requirements of the regulations, and the materials and parts that are unqualified for acceptance or re-inspection are strictly prohibited from being used, and the supervision unit shall form a corresponding exit record.

Article 23 Carry out quality appraisal activities for owners. Before the handover stage of the finished residential project between the main body of civil engineering and the decoration project, the hidden stage of the installation project, and the acceptance of the households, the construction unit shall arrange the opening activities of the construction site, collect the opinions or suggestions of the buyers on the quality of their respective houses and public parts, rectify and implement the quality problems that do not meet the design requirements and standard specifications, and form closed data. The construction unit shall provide the necessary safety facilities and safe walking passages to provide buyers with safe viewing conditions.

Article 24 After the completion of the renovation project, the construction unit shall entrust a testing institution with corresponding qualifications to conduct indoor environmental pollutant concentration testing, and if the test results are unqualified, the completion acceptance shall not be organized.

Article 25 Implement a household acceptance system for the quality of finished residential products. Before the completion and acceptance of the finished residential project, the construction unit shall organize the general contracting of construction, the professional contracting of building decoration and decoration projects, the supervision unit and other relevant personnel to carry out household acceptance in accordance with the regulations. Where a property company has been selected, the property company may be invited to participate in the acceptance of the sub-household. The acceptance of each household focuses on the safety performance, use function, visual quality and geometric dimensions involved in the decoration and decoration division project.

Article 26 When the finished residential project is delivered for use, the construction unit shall hand over to the owner of the house together with the "Residential Instruction Manual" the certificate of acceptance of the household, the detailed list of the main decoration materials (structural accessories, parts, equipment, etc.), the instruction manual, the electrical (intelligent) network pipeline and the schematic diagram of the water supply and drainage pipes.

Article 27 The construction unit shall clarify to the buyer of commercial housing the quality warranty method and warranty standard for the residential full decoration project, and shall stipulate the quality standards of building materials and parts that are likely to cause disputes over quality and quality determination.

The construction unit should do a good job in the corresponding after-sales service work, set up a project quality defect complaint acceptance and warranty management agency, smooth the complaint feedback channel, establish an internal complaint handling mechanism, and timely handle the demands of home buyers.

Before the property service enterprise undertakes the property, it shall jointly undertake the inspection of the common parts of the property and the common facilities and equipment in the residential property management area in accordance with the contract, and may invite the county (city) where the property is located, the district property management department, the street office (town people's government), and some owners to participate.

Article 28 The warranty period of the construction unit of the finished residential building to the construction unit shall be calculated from the date of completion and acceptance, and the warranty period of the construction unit to the resident shall be calculated from the date of delivery.

Article 29 Where a construction unit is suspected of false publicity in the process of selling finished residential products, the buyer may report to the market supervision department with relevant evidence clues, and the market supervision department shall investigate and deal with it according to law.
