Mandatory scrapping standards for motor vehicles are stipulated

  Article 1 These Provisions are formulated in accordance with the "Road Traffic Safety Law of the People's Republic of China" and its implementing regulations, the "Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution", and the "Law of the People's Republic of China on the Prevention and Control of Noise Pollution", in order to ensure road traffic safety, encourage technological progress, and accelerate the construction of a resource-saving and environment-friendly society.

  According to the use of motor vehicles and safety technology and emission inspection status, the State implements compulsory scrapping of motor vehicles that meet the scrapping standards.

  Commerce, public security, environmental protection, development and reform and other departments shall, in accordance with their respective duties, be responsible for the supervision and management of the recycling and dismantling of scrapped motor vehicles, and the implementation of the compulsory scrapping standards for motor vehicles.

  In any of the following circumstances, a registered motor vehicle shall be forcibly scrapped, and its owner shall hand over the motor vehicle to the scrapped motor vehicle recycling and dismantling enterprise, and the scrapped motor vehicle recycling and dismantling enterprise shall register, dismantle, destroy, etc. in accordance with regulations, and submit the scrapped motor vehicle registration certificate, number plate, and driving permit to the traffic management department of the public security organ for cancellation:

  (1) Reaching the service life provided for in Article 5 of these Provisions;

  (2) After repair and adjustment, it still does not meet the relevant requirements of the national standards for motor vehicle safety technology for vehicles in use;

  (3) After repairing and adjusting or adopting control technology, the discharge of pollutants or noise into the atmosphere still does not meet the relevant requirements of national standards for vehicles in use;

  (4) Failing to obtain a motor vehicle inspection pass mark within three consecutive motor vehicle inspection cycles after the expiration of the inspection period.

  The service life of various types of motor vehicles is as follows:

  (1) Small and micro taxi passenger cars are used for 8 years, medium-sized taxi passenger cars for 10 years, and large taxi passenger cars for 12 years;

  (2) Leasing a passenger car for 15 years;

  (3) Small coach passenger cars are used for 10 years, medium-sized coach passenger cars for 12 years, and large coach passenger cars for 15 years;

  (4) 13 years of use of public transport passenger cars;

  (5) Other small and micro operating passenger cars for 10 years, and large and medium-sized operating passenger cars for 15 years;

  (6) Use of special school buses for 15 years;

  (7) Large and medium-sized non-operating passenger cars (except large cars) used for 20 years;

  (8) Three-wheeled vehicles and low-speed trucks equipped with single-cylinder engines shall be used for 9 years, low-speed trucks equipped with multi-cylinder engines and mini-trucks shall be used for 12 years, dangerous goods transport trucks shall be used for 10 years, and other trucks (including semi-trailer tractors and fully trailer tractors) shall be used for 15 years;

  (9) 15 years of use of special operation vehicles with cargo carrying functions, and 30 years of special operation vehicles without cargo functions;

  (10) Full trailers and dangerous goods transport semi-trailers are used for 10 years, container semi-trailers are used for 20 years, and other semi-trailers are used for 15 years;

  (11) Positive three-wheeled motorcycles are used for 12 years, and other motorcycles are used for 13 years.

  For small and micro taxi passenger cars (except pure electric vehicles) and motorcycles, the relevant departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government may formulate regulations stricter than the above service life in light of the actual local conditions, but small and micro taxi passenger cars shall not be less than 6 years, positive three-wheeled motorcycles shall not be less than 10 years, and other motorcycles shall not be less than 11 years.

  There is no service life limit for small and micro non-operating passenger cars, large non-operating cars, and wheeled special mechanical vehicles.

  The starting date of the service life of the motor vehicle is calculated according to the date of registration, but if the registration procedures have not been completed for more than 2 years from the date of leaving the factory, it shall be calculated according to the date of departure.

  Motor vehicles that change the nature of use or transfer registration shall determine the service life and scrap in accordance with the following relevant requirements:

  (1) Where operating passenger cars and non-operating passenger cars are converted to each other, they shall be scrapped in accordance with the provisions on operating passenger cars, but where small and micro non-operating passenger cars and large non-operating cars are converted into operating passenger cars, the cumulative service life shall be calculated in accordance with the formula set forth in Annex 1 to these Provisions, and shall not exceed 15 years;

  (2) Different types of operating passenger cars are converted into each other and scrapped in accordance with the stricter provisions of the service life;

  (3) Where small or micro taxi passenger cars and motorcycles need to be transferred out of the province, autonomous region, or municipality directly under the Central Government to which they are registered, they shall be scrapped in accordance with the stricter provisions on the service life;

  (4) Where dangerous goods transport trucks or semi-trailers are converted into other trucks and semi-trailers, they shall be scrapped in accordance with the provisions on dangerous goods transport trucks and semi-trailers.

  Motor vehicles within 1 year (including 1 year) of the service life required by these Provisions shall not change the nature of use, transfer ownership or transfer out of the municipal administrative region of the place of registration.

  The State guides the scrapping of motor vehicles that have reached a certain mileage.

  For motor vehicles that have reached the following mileage, the owner of the motor vehicle may deliver the motor vehicle to the scrapped motor vehicle recycling and dismantling enterprise, and the scrapped motor vehicle recycling and dismantling enterprise shall register, dismantle, destroy, etc. in accordance with the regulations, and submit the scrapped motor vehicle registration certificate, number plate, and driving permit to the traffic management department of the public security organ for cancellation:

  (1) Small and micro taxi passenger cars drive 600,000 kilometers, medium-sized taxi passenger cars drive 500,000 kilometers, and large taxi passenger cars travel 600,000 kilometers;

  (2) Leasing passenger cars to drive 600,000 kilometers;

  (3) Small and medium-sized coach passenger cars travel 500,000 kilometers, and large coach passenger cars travel 600,000 kilometers;

  (4) Bus passenger cars travel 400,000 kilometers;

  (5) Other small and micro operating passenger cars driving 600,000 kilometers, medium-sized operating passenger cars driving 500,000 kilometers, and large operating passenger cars driving 800,000 kilometers;

  (6) Special school buses drive 400,000 kilometers;

  (7) Small and micro non-operating passenger cars and large non-operating cars drive 600,000 kilometers, medium-sized non-operating passenger cars drive 500,000 kilometers, and large non-operating passenger cars travel 600,000 kilometers;

  (8) Mini trucks travel 500,000 kilometers, medium and light trucks travel 600,000 kilometers, heavy-duty trucks (including semi-trailer tractors and fully trailer tractors) travel 700,000 kilometers, dangerous goods transport trucks travel 400,000 kilometers, and low-speed trucks equipped with multi-cylinder engines travel 300,000 kilometers;

  (9) Special operation vehicles and wheeled special mechanical vehicles driving 500,000 kilometers;

  (10) Three-wheeled motorcycles travel 100,000 kilometers, and other motorcycles travel 120,000 kilometers.

  Article 8:"Motor vehicles" as used in these Provisions refers to cars, trailers, motorcycles, and wheeled special mechanical vehicles that are driving on the road; non-operating passenger cars refer to passenger cars for personal use that individuals or units do not use for the purpose of obtaining profits; dangerous goods transport trucks refer to vehicles specifically used for the transportation of dangerous goods such as highly toxic chemicals, explosives, radioactive materials, corrosive substances; and change in the nature of use refers to the change of the nature of use from operation to non-operation or from non-operation to operation, small and micro leasing, leasing, leasing, Coaches and other different types of operating passenger cars are converted to each other, and dangerous goods transport trucks are converted to other trucks. The inspection period referred to in these Provisions refers to the motor vehicle safety technical inspection period stipulated in the Regulations on the Implementation of the Road Traffic Safety Law of the People's Republic of China.

  Article 9: The standards for the service life of small and micro taxi passenger cars or motorcycles formulated by the relevant departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government in accordance with Article 5 of these Provisions shall be promptly announced to the public and reported to the Departments of Commerce, Public Security, and Environmental Protection under the State Council for the record.

  Article 10 The scrapping standards for tractors on the road shall be formulated separately.

  Article 11: These Provisions take effect on May 1, 2013. Where the scrapping standards set forth in these Provisions have been met before May 1, 2013, they shall be scrapped before April 30, 2014.
