After the meeting, Ding mysteriously asked Sun to prepare a bank card to open online banking, but did not explain the specific purpose.
A few days later, Sun took the bank card borrowed from a friend to find Ding. Ding told Sun that he had made a single with a friend before, earned 100,000 yuan, and finally the two were equally divided. If it is done this time, it will also be divided according to this proportion. Thinking that the return was so high, Sun immediately agreed.
Seeing that Sun was so cheerful, Ding no longer covered up, immediately took out a U disk and inserted it on the laptop he brought, showed Sun a hacking software and operation tutorial inside, saying that this was sent to him by his friend, but he couldn't get it, hoping that Sun would help operate it.
A bizarre recharge transaction
With his own network technical knowledge reserves, Sun Mou quickly understood the operation methods and fraud methods mentioned in the tutorial, and according to Ding's instructions, logged into a website to register an account, and then downloaded the software of the same name on the mobile phone and connected it to the hacking software.
After some discussion between the two to determine the recharge amount, Sun used his mobile phone to log on to the website to recharge, and then used hacking software to modify the recharge data, so that a recharge order of 888888 yuan was actually paid only 1 yuan.
Finally, Sun mou then complained to the website customer service and asked the other party to charge the money into the account. After some operation, the two withdrew 400,000 yuan to sun's borrowed bank card, and divided the ill-gotten wealth equally according to the previous agreement. As for the remaining part that could not be withdrawn, it was also used for consumption by them.
A trial after seven years
In December 2014, a web technology company operating the site noticed that it had inexplicably lost a large amount of money while taking inventory. After some investigation, it was found that some customers used the method of forging orders to deceive the recharge system and customer service personnel, and immediately sent someone to the Xuhui Public Security Bureau to report the case. Soon, Ding mou and friends who taught him the method of committing crimes were arrested and arrested. During the interrogation of Ding, the procurator was keenly aware of Sun's existence and proposed to the police to pursue him.
On the other hand, Sun was horrified when he learned that Ding and others had been arrested and immediately hid. In the past seven years, Sun has been worried and hiding in Tibet, unable to live like a normal person, for fear of being caught by the police because of the clues. But as he grew older, he gradually realized that it was impossible to go on like this, and only by facing the crimes committed and bearing the corresponding punishments could he return to society and become a normal person again. With such an idea, Sun finally plucked up the courage, chose to turn himself in, and confessed the facts of the crime to the prosecutor after arriving at the case.
Through the interrogation of the two and the study and judgment of the evidence, the procurator believes that in this case, after Ding and Sun used technical means to modify the recharge data, they deceived the customer service trust to manually recharge through complaints, defrauding the victim company of more than 880,000 yuan, an amount of which was particularly huge, and their behavior violated articles 266 and 25, paragraph 1 of the Criminal Law of the People's Republic of China, constituting the crime of fraud and a joint crime.
After the Xuhui District People's Procuratorate initiated a public prosecution in accordance with the law, the Xuhui District People's Court sentenced Ding to 10 years' imprisonment, deprivation of political rights for two years, and a fine of 50,000 yuan for fraud; Sun was sentenced to seven years' imprisonment and fined 50,000 yuan for fraud in accordance with the law; and the remaining personnel involved in the case were punished accordingly for the crime of fraud in accordance with the law.
