Warning case one

A paint company was penalized for failing to take reliable safety measures to store hazardous chemicals

On May 28 last year, when the Municipal Emergency Management Bureau conducted a law enforcement inspection of a paint company in our city, it found that the company had stored 359 kilograms of dangerous chemicals, including two-component series paint, in the storefront it operated. From the site point of view, the storage site has not adopted reliable security measures and no special safety management system has been established.

This act violates the second paragraph of article 36 of the Work Safety Law of the People's Republic of China (2014 edition), and production and business units producing, operating, transporting, storing, using dangerous goods or disposing of discarded dangerous goods must implement relevant laws, regulations and national standards or industry standards, establish a special safety management system, take reliable safety measures, and accept supervision and management implemented by the relevant competent departments according to law.

The Municipal Emergency Management Bureau imposed an administrative penalty of a fine of 50,000 yuan on the parties in accordance with the law.

Warning case two

An enterprise was investigated and punished according to law for failing to store hazardous chemicals in accordance with regulations

On the afternoon of March 3 last year, when the law enforcement personnel of the Municipal Emergency Management Bureau inspected a parking lot in Choujiang Street, they found that an enterprise did not store the hazardous chemicals sodium hypochlorite and liquid alkali in the place according to regulations, of which sodium hypochlorite was 30.93 tons and liquid alkali was 22.34 tons. After further investigation, it was learned that the company held a hazardous chemical business license issued by the Emergency Management Bureau of Quzhou City, Zhejiang Province, and the licensed business address was a certain place in Quzhou City, Zhejiang Province, and the mode of operation was to operate without storage.

The company's failure to store the hazardous chemicals sodium hypochlorite and liquid alkali in a parking lot in Choujiang Street violated the provisions of Article 21 of the "Zhejiang Provincial Safety Production Regulations": Units that have obtained a hazardous chemical business license without storage facilities shall not store hazardous chemicals in a special warehouse, special site or special storage room other than the special warehouse, special site or special storage room that meets the safety conditions of the supplier and the user unit. Hazardous chemical stores can only store hazardous chemicals in small packages for civilian use.

In accordance with the provisions of Article 45 of the Regulations on Work Safety of Zhejiang Province, the Municipal Emergency Management Bureau imposed an administrative penalty of a fine of 95,000 yuan on the company.

Warning case three

An enterprise was investigated and punished according to law for failing to truthfully record the safety production training and education of its employees

On May 28 last year, law enforcement officers of the Municipal Emergency Management Bureau inspected an enterprise producing photocuring glue for hazardous chemicals in Yiting Town and found that employees were using mobile phones in the explosion-proof area of the production workshop. After investigation, it was found that the employee was not aware of the prohibition of receiving mobile phones in the explosion-proof area of the production workshop.

According to the investigation, the company did not train and educate employees on the working environment and risk factors, and the education and training files did not truthfully record the safety production training and education of employees. The above conduct violates paragraph 4 of Article 25 of the Work Safety Law of the People's Republic of China (2014 Edition). According to the provisions of Item 4 of Article 94 of the Work Safety Law of the People's Republic of China (2014 Edition), the Municipal Emergency Management Bureau imposed an administrative penalty of a fine of 5,000 yuan on the company.

Warning case four

A company operating hazardous chemicals without permission was investigated and punished according to law

On February 23 last year, when the law enforcement personnel of the Municipal Emergency Management Bureau inspected the law enforcement of a company located in Sitong West Road in Shangxi Town, they found that the enterprise stored dangerous chemicals such as tablet alkali, ammonia, and ammonium sulfate on the first floor, and the office stored relevant bills for the sale of hazardous chemicals, and the parties were suspected of operating hazardous chemicals without permission.

After further investigation, the law enforcement personnel found that the parties had set up points in Shangxi Town without obtaining a hazardous chemical business license to operate the relevant materials of the electroplating process, and some of the products they sold were hazardous chemicals, mainly sold to electroplating plants throughout the country, and the illegal income from the sale of hazardous chemicals had exceeded 50,000 yuan, and there was also the operation of explosive-prone chemicals and highly toxic chemicals. The conduct of the parties violated the first paragraph of Article 33 of the Regulations on the Safety Management of Hazardous Chemicals: without permission, no unit or individual may operate hazardous chemicals.

Since the case has been involved in criminal matters, in accordance with the relevant provisions of the Regulations on the Safety Management of Hazardous Chemicals and the Provisions on the Transfer of Suspected Criminal Cases by Administrative Law Enforcement Agencies, the staff of the Municipal Emergency Management Bureau has transferred the case to the public security organ for further investigation, and the public security organ will pursue its criminal responsibility according to law.
