The 261st Western Cake Shop of Beijing Weiduomei Food Co., Ltd. violated the relevant provisions of the Price Law of the People's Republic of China and was given a warning by the Beijing Dongcheng District Market Supervision and Administration Bureau and fined 50,000 yuan.

After investigation, on May 25, 2021, when the 261st Bakery of Beijing Weiduomei Food Co., Ltd. sold bread, the consumer purchased 1 Danish red bean bread at a price of 19.90 yuan / piece, and 3 whole wheat toasts at a price of 11.90 yuan / piece. A total of 55.60 yuan receivable, the day of membership, consumer consumption of products full of 50 yuan, and the use of stored value card payment, should give members a full single 12% discount, because the day of danish red bean bread has a 90% discount activity, the system defaults that the two activities conflict is not repeated to enjoy, should be manually selected by the clerk, but due to the clerk's mistake, not selected, resulting in consumers to buy Danish red bean bread in accordance with the 10% discount, a total discount of 1.99 yuan. Other breads are not discounted. This act violates the provisions of Article 14, Paragraph 1, Item (4) of the Price Law of the People's Republic of China.

According to the first paragraph of Article 40 of the Price Law of the People's Republic of China, the Market Supervision and Administration Bureau of Dongcheng District of Beijing Municipality decided to give the following administrative penalties: a warning and a fine of 50,000 yuan.

Article 14 of the Price Law of the People's Republic of China stipulates that business operators shall not engage in the following improper price behaviors:

(1) Colluding with each other to manipulate market prices, harming the lawful rights and interests of other business operators or consumers;

(2) Dumping at prices below cost in order to crowd out competitors or monopolize the market, in addition to lawfully reducing prices for fresh commodities, seasonal commodities, backlogging commodities, etc., disrupting the normal order of production and operation, and harming the interests of the State or the lawful rights and interests of other business operators;

(3) Fabricating or disseminating information on price increases, inflating prices, or promoting excessively high commodity prices;

(4) Using false or misleading price means to trick consumers or other business operators into trading with them;

(5) Providing the same goods or services, and imposing price discrimination on other business operators with the same trading conditions;

(6) Using means such as raising or lowering grades to acquire or sell commodities or provide services, increasing or lowering prices in disguise;

(7) Violating the provisions of laws and regulations to obtain huge profits;

(8) Other improper price practices prohibited by laws or administrative regulations.

Article 40 of the Price Law of the People's Republic of China stipulates: If a business operator commits any of the acts listed in Article 14 of this Law, he shall be ordered to make corrections and confiscate the illegal gains, and may also be fined not more than five times the illegal gains; if there are no illegal gains, he may be given a warning and may also be fined; if the circumstances are serious, he shall be ordered to suspend business for rectification, or the administrative organ for industry and commerce shall revoke his business license. Where relevant laws have other provisions on the punishment of the conduct listed in article 14 of this Law and the organs that punish them, they may be implemented in accordance with the provisions of the relevant laws.

Where there are acts listed in subparagraphs (1) and (2) of Article 14 of this Law, if they are of a national nature, they shall be determined by the competent pricing department under the State Council; if they are provincial or sub-provincial, the competent pricing departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall determine them.
