Beijing Baidu Catering Company was incorporated in 2012, and its business scope includes catering management and catering services. The first, third, seventh and eighth branches of Beijing Baidu were registered and established in 2012, 2013, 2014 and 2015 respectively. The above five companies use a large number of "Baidu", "Baidu barbecue" and "Baidu sugar" logos in the name, decoration, advertising, WeChat public account, Meituan APP, etc. of the stores they operate.
Baidu then sued the five companies to the Beijing Intellectual Property Court. Baidu Company appealed to the court to grant the "Baidu" trademark protection as a well-known trademark on "providing Internet search engine services"; ordered the five companies to immediately stop infringing the exclusive right to use the "Baidu" trademark and immediately stop the act of unfair competition.
In the complaint, Baidu also requested that the five companies be ordered to jointly compensate for economic losses of 4.95 million yuan and reasonable expenses of 50,000 yuan for rights protection, and ordered the five companies to publish a statement in China Intellectual Property News to eliminate the impact of infringement.
After trial, the Beijing Intellectual Property Court held that Baidu Company used "Baidu" as its core registered trademark logo in the course of its business operations, and after long-term and extensive continuous use and publicity and promotion, "Baidu" has achieved high popularity and market recognition among the relevant public.
In addition, a number of effective judgments have successively held that the "Baidu" trademark No. 1579950 (hereinafter referred to as the trademark involved in the case) has constituted a well-known trademark in the service of "providing Internet search engines by means of computer information networks".
