In order to further improve the efficiency of enforcement of property-related cases, timely safeguard the winning rights and interests of the applicant for enforcement. The Wolong District People's Court of Nanyang City decided to carry out a one-week special enforcement week for property disposal from November 22, 2021.
Case 1
Li Mou, who lives in Wolong Road, Nanyang City, borrowed 300,000 yuan from Yang in 2015 due to the turnover of project funds, and after the expiration of the repayment period, after Yang repeatedly urged, Li only fulfilled part of the arrears, and delayed repayment for the remaining part on the grounds of difficulty in capital turnover. In desperation, Yang sued the court. After trial, the court ruled that Li should repay the money owed by Yang in accordance with the law. Because Li has not fulfilled his repayment obligations, Yang applied to the court for compulsory enforcement, and the case entered the enforcement procedure.
In the course of enforcement, Chen Xu, an enforcement officer, issued relevant legal documents such as an enforcement notice and a property report order to the person subject to enforcement in accordance with the law, and interviewed Li many times to urge him to repay the loan as soon as possible, but the person subject to enforcement was lucky, had a strong attitude, and refused to perform. After conducting a comprehensive inquiry into the deposits, vehicles, and real estate information under Li's name, Chen Xu found that the deposit under Li's name was not enough to repay the arrears, but there was a real estate in his name, and because the executor had been delaying performance, Chen Xu decided to take the compulsory auction of the property as a breakthrough in the case and started the appraisal and auction procedure for the real estate. When Li learned that his property would be auctioned online, he finally realized the seriousness of the problem and hurriedly took the initiative to contact Chen Xu to say that he wanted to repay the money. On November 22, 2021, the judgment debtor Li paid the execution money to the applicant yang in one lump sum, and the case was successfully concluded.
Case 2
On January 16, 2020, when Deng was driving a two-wheeled motor vehicle to the west end of Meixi Bridge, he was hit by a two-wheeled electric vehicle driven by Ding. Due to the unsuccessful negotiation on the issue of compensation, Deng sued the court. After the court trial, ding was ordered to pay compensation of 83442.49 yuan to Deng. After the judgment took effect, because Ding did not perform the obligations specified in the effective judgment on time, Deng applied to the court for compulsory enforcement.
After the case entered the enforcement stage, the enforcement officer Xu Ge interviewed Ding many times, but Ding always refused to meet for various reasons, and the execution of the case once reached an impasse. However, Xu Ge did not give up on this and has been constantly paying attention to the whereabouts of the person subject to enforcement and the clues to the property under his name. Through the network inspection and control system, it was found that the executor had a property located in a street in Nanyang City. On November 25, 2021, the enforcement officers came to the community, found the executor Ding Mou in the property involved in the case and detained him to the court. In the court, Xu Ge, an enforcement officer, conducted criticism and education on the person subject to enforcement, and patiently and meticulously did his ideological work, persuading him to think in a different position and actively perform it. In the end, with xu Ge's efforts, the executor realized his mistake, raised the execution funds through his family, and handed it over to the applicant for execution, and the case was successfully concluded.
In this special execution week of property disposal, the Wolong District Court executed a total of 20 sets of houses, 8 sets of appraisal properties, 2 vacated houses, 5 sets of transaction real estate, 1 vehicle, and the amount of enforcement in place was more than 9 million yuan, which achieved good legal and social effects.
