On August 4, the Xuanzhou District People's Court of Xuancheng City held a public hearing to hear the defendant Liu Jian, who was prosecuted by the procuratorate, for illegal mining, picking quarrels and provoking trouble, and forcing trading, the defendant Huang Qikun for illegal mining, the defendant Ding Ping for illegal mining, picking quarrels and provoking trouble, and forcing trading, the defendants Hu Hongbing, Xue Mingjun, and Gao Ji for illegal mining and picking quarrels and provoking troubles, the defendants Dai Hui and Li Zheng for picking quarrels and provoking troubles, and the defendant Wang Yongguo for picking quarrels and provoking troubles. Defendant Shen Qinyu and others committed the crime of illegal mining.
After reviewing in accordance with law, the procuratorial organs ascertained that in September 2008, defendant Liu Jian, defendants Gao Ji, Xue Mingjun, Wang Yongguo, and others committed the illegal and criminal acts of picking quarrels and provoking troubles in the process of getting acquainted, which to a certain extent strengthened the social prestige of Liu Jian and others. Since August 2014 to April 2019, defendant Liu Jian, together with defendants Huang Qikun, Shen Qinyu, Ding Pingping, Gao Ji, Xue Mingjun, and others, in order to obtain market economic benefits from the placer mining market, have systematically carried out illegal and criminal activities of illegal mining in Langchuan River in Langxi County, Baichekou Radish Beach in Xinfa Town, Langxi County, and Huanglongzui in Nanyi Lake, Xuanzhou District, under the cover of dredging of rivers and mining permits.
During this period, in order to maintain the monopoly of placer mining and exclude others, defendant Liu Jian instructed defendants Ding Ping, Shen Qinyu and others to intimidate the villagers, that is, the victim Zhu Mou; In order to deter local villagers from illegally mining sand in the Dongxia sand farm, defendant Liu Jian instructed defendants Ding Pingping, Gao Ji, Xue Mingjun, Wang Yongguo and others to organize the gathering of crowds at Baichekou to intimidate local villagers; In order to meddle in the stone market of others, defendant Liu Jian, behind the scenes, for the defendants Dai Hui, Ding Ping, and Li Zhengti to help and mediate, beat the victim Gu X, forcibly entered the stone business of the victim Peng X and others, and obtained illegal benefits under the condition of zero investment; Because of trivial matters, defendant Liu Jian gathered defendants Ding Ping, Gao Ji, Xue Mingjun, and others to fight fiercely, beat the victim Wu Shiqiang, and stuffed him into a car and drove to a remote place to continue beating him, causing a bad social impact.
In recent years, defendant Liu Jian and others have also taken advantage of the shelter of Li Jun, former head of the Water Administration and Water Resources Unit of the Langxi County Water Conservancy Bureau and deputy head of the Water Administration Supervision Brigade (who has been sentenced), to disregard government management, openly challenge public power, and wantonly illegally exploit placer mines, seriously damaging the local natural ecological resources and environment. Defendants Liu Jian, Ding Ping, Gao Ji, and others gradually formed a criminal group of evil forces with stable organization, clear hierarchies, and a clear division of labor, of which defendant Liu Jian was the leading member of the criminal group of evil forces, and defendants Ding Jian, Huang Qikun, Shen Qinyu, Gao Ji, Wang Yongguo, Xue Mingjun, Dai Hui, Li Zheng, Hu Hongbing, Shen Jianjun, Lu Qianshuang, and Cao Haiguang were the main members of the criminal group of evil forces.
This year is the final year of the special struggle against organized crime and evil forces. With the normalization of the prevention and control of the new crown pneumonia epidemic and the in-depth development of the "six clearances" action of the special struggle against organized crime and evil, the Xuanzhou District People's Court made full use of remote video technology to try cases involving criminal syndicates and evil forces, reduced the stock, digested the increment, and made every effort to promote the settlement of cases.
