Recently, the enforcement officers of the Wushan County People's Court of Chongqing Municipality conducted outdoor supervision at the scene of Quzhi Township in chongqing, and the workers lifted the ruins, cut the residual ladder, measured the size, welded the steel frame... A brand-new spiral staircase rises from the ground and becomes a "convenient ladder" for the applicant executor. The local police station police, village cadres, and team members stationed in the village witnessed this moment on the spot.
It is reported that Zhang Jia (female) and Zhang Yi (male) are brothers and sisters. In October 2020, his brother Zhang Yi smashed the stairs involved in the case on the adjacent house built by his sister Zhang Jia on 5 steps, hindering Zhang Jia's convenience. In November of the same year, Zhang Jia took Zhang Yi to court on the grounds of eliminating obstruction. During the trial, due to Zhang Yi's demolition of the walls of the original self-built house, most of the stairs involved in the case fell off, and the relationship between the brothers and sisters was tense and they did not accept mediation. After the court ruled, Zhang Yi compensated Zhang Jia for economic losses of 5,000 yuan; after Zhang Yi compensated for economic losses, Zhang Jia restored the damaged stairs by himself, and Zhang Yi must not cause obstruction. Zhang Yi did not perform this, and Zhang Jia applied to the court for compulsory enforcement.
The enforcement judge went to the door several times to mediate, requiring the judgment debtor Zhang Yi to respect and obey the judgment, and to protect the lawful rights and interests of the right holder who won the lawsuit. Zhang Yi fulfilled all his compensation obligations, but still prevented Zhang Jia from restoring the damaged stairs on his own on the grounds that the restoration stairs would occupy its foundation and expose the privacy of his bathroom. In order to reflect the temperature of the law, and to truly solve the problem within the scope of legal principles, and to promote reconciliation between the two sides, the enforcement judge proposed a plan for Zhang Jia to build a spiral staircase (the width of the stair base is 150cm, the width of the ladder is 75cm, and the corner of the ladder does not exceed the outer edge of Zhang Yi's bathroom window) through on-site investigation, in order to avoid the impact of the stairway on Zhang Yi after its completion.
Zhang Yi finally accepted and agreed to the implementation of the plan.
