"Meet Tesla by car, stay away from it. This is a joke about Tesla.

After entering the Chinese market in a big way, Tesla has two distinct labels, one is "the leader of new energy vehicles", and the other is "unstoppable". The strange thing is that these two labels don't seem to contradict each other. Objectively, Tesla's sales have never been lost, and accidents about it have not been broken.

Following a series of events such as the Shanghai Auto Show, Chaozhou, and Hainan, Tesla has recently encountered "old" trouble.

On November 25, a Tesla collided with 11 vehicles in Longquanyi District, Chengdu, resulting in three minor injuries and damage to many vehicles. Mr. Wang (pseudonym), the owner of the Tesla involved in the accident, publicly claimed the next day that the root cause of the accident was not himself, but the Tesla he was driving. After the incident, the Chengdu police reported it, and Tesla's "can't brake" was once again moved to the screen.

At the moment, there are no authoritative results for this accident, but several previous accidents have results. After nearly three years, the "Shanghai Auto Show Incident" and "Chaozhou Accident" came to light, and Tesla became the nominal "winner". However, from the accident to the "closure", the long-term investigation and the difficult identification of accident responsibility have caused a lot of losses to the owner and Tesla.

With the development of new energy vehicles to this day, with the popularization of assisted driving, accident identification has become a problem in the industry. The protected data of car companies, the lack of relevant laws and regulations, and the "unprofessionalism" of market appraisal agencies are all kinds of problems that need to be accelerated and improved in the face of the interests of car owners and car companies.

Tesla is "out of control" again

In this Chengdu Tesla accident, the dashcam of the rear vehicle took a full video.

The video shows that on the urban road, all the vehicles were waiting for the traffic light at the intersection, at this time, a white Tesla suddenly rushed out, and the speed was particularly fast, directly knocking the black Audi off. The scene of the accident was a mess, with all kinds of car parts scattered all over the place, and many cars were seriously damaged. The front left side of the front of the Tesla, the vehicle that caused the accident, was smashed to pieces, and the front wheel was missing.

As can be seen from the video, at the time of the incident, the Tesla brake light involved was always on. This caused netizens to speculate about brake failure, and a series of questions followed. "At a speed of 132 km/h, the airbag didn't pop out, and can the car still maintain power and power?" "The owner obviously stepped on the brakes, and the high-mounted brake light also lit up, why can't he brake?" "What was the speed of the car at the time of the first collision, and why didn't the AEB function be triggered?"

The day after the accident, Mr. Wang, the owner of the car, also quickly ushered in the "condolences" of the media.

According to Mr. Wang, the owner of the car, he cooperated with the police to conduct relevant inspections after the accident, and he was not involved in drunk driving and drug driving. On the morning of the 25th, the license plate was just on the day of the accident, and the automatic driving and single-pedal mode were not turned on at that time. When passing through a subway station intersection, the vehicle suddenly accelerates and loses the ability to control the car.

Of course, there are also automotive industry bloggers who have different voices.

The blogger "Yanshan Pai" said: When the high-level brake light is on, whether it is the driver's operation or the active braking system intervention, the braking action has already been made. If the driver keeps pressing on the accelerator, the AEB will not intervene, the high-mounted brake light will not illuminate, and if there are multiple collisions and the airbag has been deployed in the early collision, the car will automatically and urgently brake to avoid subsequent collisions, regardless of speed. From this point of view, the main cause of this accident is that the speed of the car is too fast.

On November 27, Tesla responded to the accident. Tesla issued a document saying: Through checking the background data, it was found that when the collision occurred in the video, the accelerator pedal of the vehicle involved was pressed 100% deeply, and the speed of the vehicle increased from 54km/h to 132km/h at the time of the collision.

Regarding the vehicle's brake light on in the video, Tesla said that this is because the collision in the video is not the first collision, in fact, after the first collision, the vehicle's "multi-collision braking" function is triggered, so the brake light has been lit in the video. Background data also shows that the driver did not press the brake pedal for 2 seconds after the collision in the video.

In addition, Tesla also said that by checking the background data, the driver pressed the brake pedal 2 seconds after the collision in the video. Combined with the background data and the damaged state of the vehicle, the front wheels of the vehicle have fallen off after the first collision, the braking system pipeline has been damaged, and the vehicle has been unable to brake normally.

For this "response", according to the "convention", more doubts have arisen. On the whole, the angle of questioning is divided into two levels, one is Tesla's single statement and every time it is no problem, and the other is to express doubts about "multi-collision braking".

Is there a problem with Tesla's braking system? Accident liability may be more convincing than all the rhetoric.

"Can't stop" ushered in the truth one after another

The final investigation report of many accidents is the confidence that Tesla always "throws" the responsibility to the car owner.

On March 9, 2021, a video of a woman sitting on the roof of a Tesla to defend her rights" attracted public attention. In the video, Ms. Zhang sits on a Model 3 accident car with the words "Tesla brake failure" labeled with the words "Tesla brake failure" and has been crashed, and the horn loops the recording of "Tesla Model 3 brake failure during the Spring Festival, causing a traffic accident, and a family of four almost died".

This sensational event nearly three years ago has finally ushered in the court's verdict recently.

On November 22, Tesla v. Xi'an female car owner in the "Shanghai Auto Show Incident" case of infringement of reputation rights, the court made a first-instance judgment, finding that Ms. Li of Xi'an was legally liable for reputation infringement and must publicly apologize to Tesla and compensate 2,000 yuan, and bear 20,000 yuan in vehicle appraisal fees. After identification, the vehicle involved in the case did not have brake problems.

However, Tesla does not seem to be satisfied with this result. Tesla believes that the damage caused by the incident to its own amount is huge, and the judicial evaluation agency has assessed that the loss of Tesla's orders and goodwill is as high as hundreds of millions of yuan, so Tesla is planning to continue to appeal.

Not only the Shanghai Auto Show rights protection incident, but also a number of accusations about Tesla's "brake failure" in recent years, many of which have ushered in the "truth", such as the tragic Chaozhou Tesla incident.

On November 5, 2022, a Tesla in Chaozhou, Guangdong Province, was suspected of losing control and driving at high speed for more than 2 kilometers, hitting a motorcycle, multiple bicycles and a tricycle one after another, resulting in 2 deaths and 3 injuries. After the incident, Tesla was subjected to unprecedented public pressure and ushered in a real crisis of confidence.

According to the Shanghai Securities News, a few days ago, Tesla sued a self-media reputation infringement case, and the court ruled in favor of Tesla. According to the verdict, according to the results of the judicial appraisal, the cause of the Tesla Chaozhou accident has nothing to do with the vehicle itself. Before the verdict was made, in the video introducing the trial released by the self-media, it was also mentioned that the appraisal results showed that the cause of the Tesla Chaozhou accident had nothing to do with the vehicle itself.

More than that, in 2020, a car owner in Nanchong, Sichuan Province "lost control" and hit someone, and the appraisal results of a judicial appraisal center in Sichuan Province showed that no potential safety hazards were found in the vehicle. In 2021, a car owner in Taizhou, Zhejiang Province collided with two traffic police officers who were handling the accident, and the appraisal results of an authoritative research institute in Taizhou showed that the accident had nothing to do with the Tesla vehicle itself. In 2023, a high-speed bus collision incident in Ruian Qian, Zhejiang, and the appraisal results of an authoritative appraisal center in Zhejiang showed that the accelerator pedal has been at its maximum opening...

In fact, regarding Tesla's braking problem, Zinc Finance previously mentioned in the article "Tesla, can you brake or not?", the biggest problem of Tesla's many accidents is the "one-pedal mode", when the owner is not familiar with the one-pedal mode, or encounters an emergency, it is easy to cause traffic accidents. Tesla's official investigation into a number of accidents was also attributed to the owner of the car "stepping on the wrong brakes".

It is worth mentioning that after the "Tesla brake failure" incident at the Shanghai Auto Show, a Tesla-specific foot pedal recorder was sold on the Internet. In addition, Tesla also "took the initiative" to change the strategy of forced kinetic energy recovery on one pedal this year, allowing users to adjust the strength of kinetic energy recovery by themselves.

How hard is it to distinguish between "responsibility"?

Auto accident identification has always been a troublesome matter, and a famous case is the Toyota "acceleratorgate" incident in 2009.

In this incident, NHTSA (National Highway Traffic Safety Administration) found that Toyota Camry vehicles, which have deployed a new electronic throttle control system since 2001, have more than 400% of "vehicle crash" accident complaints compared to the "manual" version of the Camry.

If the vehicle brake fails, it is generally not a hardware problem, most of it is a software problem, which can be identified by OBD computer detection of the whole vehicle.

To that end, NHTSA conducted a nationwide technical survey and enlisted the help of NASA, which has a large number of electronics and software specialist employees, and NASA was authorized to view the Camry's source code at the Toyota plant in California, which took 10 months to analyze.

However, with the development of the automotive industry in recent years, the complexity of today's new energy intelligent vehicles has far exceeded that of traditional fuel vehicles. In addition, in order to achieve autonomous driving, many car companies have rewritten the operating system, and the amount of code far exceeds that of Toyota back then. This also means that the identification of an accident after an accident has become much more difficult.

On the other hand, there are currently no professional institutions on the market to conduct investigations, and even if the professionalism is online, there are not enough manpower to investigate. The more important reason is that the driving data of the car is completely in the hands of the car company, and it is difficult for the third-party appraisal agency to obtain the relevant data, and even if it is obtained, it is difficult to distinguish the authenticity of the data, so the appraisal results will naturally lose credibility.

It is certain that Tesla is not the only car company, before, now, and in the future, "smart car" car companies will face controversial traffic accidents. The occurrence of accidents, whether for car owners or car companies, will cause a lot of losses. In such a situation, the industry generally believes that a better and faster mechanism needs to be established.

On the bright side, in recent years, the construction of the accident responsibility management system for new energy vehicles in mainland China is accelerating.

According to the newly revised Technical Conditions for Motor Vehicle Operation Safety issued by the Ministry of Industry and Information Technology, from January 1, 2022, newly produced passenger cars shall be equipped with an event data recording system (EDR) that complies with the provisions of GB39732 or an on-board video driving recording system that complies with the provisions of GB/T 38892.

In addition, in October 2022, the Ministry of Industry and Information Technology (MIIT) issued the Regulations on the Administration of Road Motor Vehicle Production Access Permits (Draft for Comments), which clarifies that personal information and important data collected and generated by ICV manufacturers in the process of product sales and use shall be stored within China in accordance with the law. Where it is truly necessary to provide it overseas due to business needs, it shall pass a security assessment organized by the State Internet Information Department in conjunction with relevant departments such as for industry and information technology, and report to the relevant departments.

It is believed that with the acceleration of the establishment of relevant mechanisms, car companies will be able to prove themselves faster and better, and consumers will be able to better protect their rights and interests.
