Jiang Ping: This is how I bring doctoral students

I qualified as a doctoral supervisor in 1991. It should be said that by 2010, after recruiting another batch of doctoral students, my doctoral students will be 20 years old.

After becoming a tenured professor at China University of Political Science and Law, my main job was actually to take doctoral students. Looking back, one of the obvious characteristics of the PhD students I brought with me was that they did not have real high-level officials in them. From this point of view, it can be said that there are both good and bad sides. The good side is that these students, when they first entered the exam, were based on their own skills, especially those in the early years, unless they were very interested in academic research, they would not take the doctoral examination. This is completely different from the situation where some officials are now purely trying to get a doctorate degree.

In terms of the way I take doctoral students, in the past 20 years, there are actually three modes:

In the earliest period, doctoral students were brought in conjunction with legislative projects. In 1991 and 1992, I was also serving as the legislative work of the Law Committee of the National People's Congress. At that time, I used to bring students such as Zhao Xudong, Kong Xiangjun, Zhou Xiaoming, Wen Haixing and so on.

Like the previous doctoral students, I will bring them with me to participate in the legislative work. Zhou Xiaoming and I drafted the Trust Law, and we went to Japan together to investigate the Japanese trust law.

In the early doctoral training, I mainly carried out it in conjunction with legislative projects. For these doctoral students, they are independently conducting research in a completely new field through the background of legislative projects, and considering how to draft relevant laws in light of China's actual conditions, and using their research results as the basis for providing the NPC to draft legal proposals. For example, Wen Haixing's doctoral dissertation at that time was about the Futures Law, and although the "Futures Law" did not come out in the end, he also combined legislation to carry out research. I think this kind of study combined with legislative projects has its advantages to a certain extent.

Later, I combined my own scientific research projects to bring the doctorate. After I left the National People's Congress, there were some scientific research projects large and small, such as those involving the drafting of the Civil Code. After I get a research project, I will involve doctoral students and cultivate students' independent research ability through scientific research projects, which I think is also a good way to bring doctoral students.

The last mode is pure guidance. Later, for a long time, I no longer applied for scientific research projects as a leader of civil and commercial law. In this way, compared with the previous two models, it has become a guidance work without legislation and without the support of scientific research projects. In this way, with students, there is not much carrier of sustenance. As a result, I gradually reduced the number of doctoral students.

For a long period of time, probably ten years or so, Yang Zhenshan and I were two doctoral students. Because at first, I was the only one with the qualification of doctoral supervisor, and later Yang Zhenshan also had a doctoral qualification qualification. At that time, there were not too many restrictions on students' majors, because civil law and commercial law, mainly because the two of us were eligible to bring, but the enrollment quota was relatively more.

So in the first few years, I had four or five PhD students in a class.

Of course, now my full-fledged PhD students have been reduced to two per year. But in addition to these two, because students from Hong Kong, Macao and Taiwan are not counted, there are also individual thesis doctors and postdoctoral fellows who are almost one per year, adding up to four or five people every year. Now that the dissertation doctorate has decreased, the famous judge Song Yushui is my last thesis doctorate.

I have developed a strong relationship with PhD students. On the one hand, I'm going to give classes to PhD students. In the past, when I was the only one with a doctoral qualification, I often had to talk about a semester's guidance class alone. Later, in cooperation with Yang Zhenshan, the two of us also took up doctoral courses. Now that there are more than a dozen doctoral supervisors, the task of lecturing has been greatly reduced.

But even so, I have many opportunities to meet students. Now, I usually meet with students once a month and invite them to my house to see what problems are in learning, what are their own opinions, and so on. In general, I have more contact with PhD students in the first two years, and in the final year, students write their own thesis, which is slightly less.

It should be said that I have brought 20 doctoral students in my life. The number of PhDs I have brought down in the past 20 years should be nearly 100 in total. I myself feel that among the 20th batch of doctoral students, those who really mix diplomas in it, or do not study hard at the doctoral level, I dare not say absolutely none, but it is very, very few. Whenever I think about this, I feel that my conscience is still very calm.

Moreover, at least from the perspective of my civil and commercial law major, the entrance examination for doctoral students, whether it is the original examination proposition, the change of papers, or the admission, is completely in accordance with academic standards. From this point of view, I also have a clear conscience.

Some of my PhD students are doing very well now. For example, the first Zhao Xudong is now very famous in the civil and commercial law circles. Another example is Kong Xiangjun, who now also serves as the president of the Third Civil Division of the Supreme People's Court. It should be said that they are very successful in all aspects, especially some students in colleges and universities, and they have also made great achievements in academic research.

In my impression, very few students in the first few batches are willing to stay in school. At that time, the biggest hope of students was to work in the Supreme Court and state organs, and if you wanted him to stay in school, people were generally reluctant. Moreover, at that time, doctoral degrees were not required to stay in the university, and undergraduate and graduate students could stay on campus. In this case, after graduating from the doctorate, you generally do not stay in a higher school. At that time, the treatment of colleges and universities was not as good as in the state public power organs from any point of view.

But then it was completely different. After about 2000, this changed completely. At that time, the first goal of students studying for doctoral studies was to stay in school and teach. Even if you can't keep the best schools, you can go to the next higher schools. In this case, it becomes attractive to stay in school, and of course the conditions for staying in school are getting higher and higher. If you want to be a university teacher, you must obtain a doctorate. In this way, the doctorate becomes a stepping stone to entering the university. And if you get a Ph.D., you don't necessarily get into a good university.

For me, all of this is very gratifying.

You will be terrified that you have been walking on a road that doesn't fit! I should live a better life, this better, should not go against the needs of my heart and social environment!

Therefore, after the old leaders of the former political and legal committee of the municipal party committee were transferred to the higher departments, I chose to do poverty alleviation work at the grassroots level in 2005, hoping that I would calm down and calm my soul in the familiar countryside. I bought a second-hand laptop at a computer market on West Road in Guiyang City (at that time, new laptops were very expensive, 10,000 or 20,000), and bought a large number of books, including the English-Chinese Dictionary, Xinhua Digest, and academic works by Jiang Ping, Wang Liming, Zhao Wanyi, Li Kaiguo, Zhang Yumin, Wang Weiguo, Li Yongjun and other famous civil and commercial law artists. My office is in the township middle school dormitory in Liubarrel Township, Xiuwen County, and I go to the poverty alleviation point in the village about twice a week, and the rest of the time belongs to me. Slowly, I eased up in the state of more than ten years of intertwined cups and cases, and returned to the college entrance examination years, immersed in the thinking of jurists, the personality of jurists, and the breath of jurists.

I read Professor Jiang Ping's words in the "Self-Preface to the Selected Works of Jiang Ping": "God is finally 'fair'. After 1957, it gave me a full 22 years of adversity, and gave me a full 22 years of good times. Adversity has given me trials and tribulations, and has made me more able to see everything with a normal mind, and one of my favorite mottos is: 'Born of sorrow, die of happiness', so is the nation and the individual. Adversity has also given me contemplation and reflection, making me more able to see everything with a normal mind, and there is nothing left to be superstitious, and another adage I love is: 'Bow down only to the truth.'" What boldness and pride this is! I clearly felt my excitement.

Next, Professor Jiang Ping's expositions on "private and public rights", "party power", "stability maintenance thinking", "the status and role of lawyers", and "political reform" are not the questions that I, a small civil servant who has stumbled and has no background resources, are not the questions that puzzled me? I hope to get close to Teacher Jiang Ping, I hope to enter this master, I made up my mind, I want to be Jiang Ping's student with my full strength. Reading Mr. Jiang Ping's doctorate and practicing Mr. Jiang Ping's academic ideals is the value of my life, and this is the realm of life that I have been pursuing!

A doctorate exam, temporarily changed the school and supervisor

After making up my mind, I did a good job in poverty alleviation at the same time; With new goals and motivation. In 2005-06, he purchased a large number of Jiang Ping's books and downloaded many of Jiang Ping's articles on the Internet. Read one by one, read page by page, and type and copy articles on your laptop when you are tired of reading. Because English had been delayed for a long time, I started by memorizing words, and I memorized the Little English-Chinese Dictionary countless times, so that I bought five dictionaries before and after, all of which were dirty and tattered. Because I spend a lot of time memorizing dictionaries on the way to the long-distance shuttle, to the fields of poverty alleviation points, and to the meeting place in the township.

At the beginning of 2006, when registration for the doctoral exam began, I suddenly felt that I had no confidence at all. "Okay? How can you get a doctorate in Chinese law? Just how many books have you read? Is it so easy to read Jiang Ping's Ph.D.?" I was completely lost, because for me Professor Jiang Ping is a master on the throne, and I know nothing about teachers except books! I gave up and temporarily filled in a doctoral supervisor in business law at a university in southwest China. Although I took leave to rent a room at the university to review, the effort was obviously not enough. Sure enough, the test score came down and passed, but he was not admitted.

The second examination for the doctorate, resigned from public office, and changed the supervisor

After the first Ph.D., I thought: If you want to study for Mr. Jiang Ping's doctorate, you must be ruthless, and you must go all out! Therefore, after returning to the unit after poverty alleviation in early 2006, I submitted my resignation to the new main leader, and everyone felt inexplicable. Some people say that it was not a blow in terms of feelings! Someone advised me that you are in your early thirties, you are the only master of the institution, and you have grassroots experience and have been a leading secretary, your career will not be bad, don't be impulsive! It seems that the authorities will not approve it for the time being. I applied for another year of poverty alleviation! With the consent of the leader, the leader also said that I have ideals!

At the 2006 citywide poverty alleviation commendation meeting, I was an outstanding individual in the city, speaking on behalf of the city's poverty alleviation team members, winning commendations at the city and county levels, and Xiuwen County's TV station broadcast my "advanced deeds" for several months. I laughed secretly, "I'm not playing with you, I'm leaving!"

After many contacts, I successfully applied for the position of office director of Beijing Shanggong Law Firm. Finally, in July 2006, the secretary's office of the Political and Legal Committee of the Guiyang Municipal Party Committee approved my resignation report, and I officially became a person outside the system.

During my time at Beijing Shanggong Law Firm, I found a house shared with an old lady near Wanshou Road in Beijing through the Internet; Work is very busy, there is a lot of entertainment. I still did not give up the preparation to study Dr. Jiang Ping, and I had to read every night. Every week, try to go to Guotu or China University of Political Science and Law to read books. However, unfortunately, no one around me introduced Professor Jiang Ping, and I have not seen Professor Jiang Ping in person during this time.

In January 2007, the annual doctoral application arrived, and I applied to China University of Political Science and Law; However, I did not dare to report Mr. Jiang Ping's doctorate, because I saw many "masters" reporting Mr. Jiangping's doctorate. These "masters" themselves are seniors I have always admired and respected, and many have written books. I temporarily changed to another mentor, who was said to have a lower score.

When I first arrived in Beijing, I changed to a very unfamiliar environment, I have always been troubled by climate and diet, and I am far away from my relatives, especially my parents, who are getting older, and my heart should not calm down. Sure enough, the doctoral exam did not give the desired results!

I will often think of my grassroots police years, the poor mountain villages where I helped the poor, those people in our small institutions, those things...

In May 2007, I heard that China University of Political Science and Law was going to hold the "Academic Newcomer Competition" in the graduate school, which was initiated by Professor Jiang Ping and donated by the "Jiangping Law Fund". At that time, teacher Jiang Ping will present awards to the winning students on the spot. I put on a backpack and casual tracksuits, and arrived early at the auditorium on College Road. (In Mr. Jiangping's book, he once talked about this place as the place where he was identified as a "rightist" and where he was most sad.) )

The atmosphere of the "Academic Newcomer Competition" is very warm, and Mr. Jiang Ping is full of vigor in his speech, and he is indeed a master! The respect and love of the students, teachers and guests for Professor Jiang Ping is beyond words!

In the evening, at more than ten o'clock, the competition ended, the students dispersed, and Teacher Jiang Ping walked out of the auditorium alone without being accompanied by anyone. I quickly walked up and asked Teacher Jiang Ping questions. The teacher said, "I'll go to the bathroom first!" After more than ten minutes, the teacher came out, I greeted him, and the teacher smiled and said, "Are you still there?" How, let's talk as we go!" Teacher Jiang Ping answered my question "about the difference between the constitution and constitutionalism": "The constitution and constitutionalism are not the same thing, constitutionalism is a state of safeguarding the absolute authority of the constitution, it is the foundation of the rule of law, and without constitutionalism, there will be no rule of law!" Then, Teacher Jiang Ping asked me, "Where do you live?" and I said, "Wanshou Road!", "We are on the same road!" Teacher Jiang Ping stood on the edge of the third ring of the Jiemen Bridge, stopped a taxi, sat in the front seat, and said to me, "Get in the car!" I was terrified and got in the car. Along the way, Mr. Jiang Ping was very interested in my grassroots experience and asked me many questions, and I answered them one by one. For this experience of first meeting Teacher Jiang Ping, I couldn't sleep at night after I came back, and I wrote a half-text and half-white article "Beijing Meets Jiang Ping Shi", in which I sighed: "Back to the apartment, I sighed to the teacher: First, pay attention to reality. Master Jiang Ping said in a eloquent way, seeking the root of the problem and paying attention to the social reality, seeking the overall law and paying attention to the crux of civil business. When I saw me today, I knew that I was from the grassroots level, or asked, "What is corruption at the grassroots level?" or comment on "public rights infringe on private rights", all of which face reality in the atmosphere; Second, the character of scholars. Of course, in 2008, fate did not favor me because I knew Teacher Jiang Ping. However, this time, I finally officially filled in the doctorate of business law of Professor Jiang Ping of China University of Political Science and Law, and seriously accepted the interview of Professor Jiang Ping. However, I still didn't get accepted because the competition was too fierce!

Four exams, five doctoral exams, gains and setbacks coexist, how far am I from Jiang Ping's doctorate?

After the failure of Kaobo in 2008, I strengthened my determination to "be a disciple of Teacher Jiang Ping". After starting a family in Beijing, with the strong support of his wife and her parents, he resigned from the good administrative management of Shanggong Law Firm and continued to study Bo. The reason why I still insist on taking the test of Mr. Jiangping's doctor: First, the teacher's rich life experience, understanding of the world and academic character are irresistible charms, and I need the teacher's guidance for me. The 2011 exam is my sixth time! Before the exam, I went to visit Mr. Jiang Ping, and the teacher said to me: "Kaobo is also an exam, which is not consistent with the actual level, I do not participate in the doctoral examination questions, the examination questions are also randomly selected from the question group, and I do not participate in the revision of the papers." You don't have to do a PhD! This time if your score doesn't reach it, the advice is given up. You are the most resilient candidate I have seen over the years, you can be my doctoral disciple, I can still guide you. If you have questions, come to me at any time, I can guide you at any time!"

Actually, I'm not made of steel, I'm not a paranoid, and I've gained a lot in six years! The gain is far greater than the loss, and with your own foundation, it is no problem to be a good lawyer in Beijing to support your family. I also know that the teacher has recognized me as a doctor outside the door, what else can I ask for?

The written exam of the light car familiar with the road, followed by the interview questions of Teacher Jiang Ping, Teacher Li Yongjun, and Teacher Wu Changzhen, I feel that the answer is not very satisfactory, but it doesn't matter anymore! Back at the guest house where I lived in the basement of the University of Political Science and Law, I had a hunch that my sixth Kaobo was out of drama again, and I cried in my room, didn't eat for a day, and slept all night.

The next day, I returned home and returned to the law firm where a few friends invited me to join the partnership, after all, there are still many things in life, just work hard, Mr. Jiang Ping's books still need to be read, and Mr. Jiang Ping's thoughts still need to be studied!

One day in April, I was busy with renovation matters in the newly opened office of Jingyue Law Firm, and in my ashen face, I received a text message from the Graduate Admissions Office of China University of Political Science and Law: "Dear Chen Bo, I am pleased to inform you: you have been admitted to the School of Civil and Commercial Economics and Law of our university as a 2011 Doctor of Civil and Commercial Law, and the supervisor is Professor Jiang Ping, please complete the household registration transfer procedures at the following time. "Now, there are no words to express my joy, I just understand: I have fulfilled my dream of being a teacher and student of Jiang Ping!

At the last birthday banquet for the teacher's 80th birthday, the teacher's doctoral and master's disciples hugged the teacher, and we shouted loudly together: "If there is an afterlife, we will still be your students!" One by one, we burst into tears.

Yes, we respect Teacher Jiang Ping, not only Teacher Jiang Ping belongs to us as students, but also because Jiang Ping belongs to this era!
