Case review
Zhang (born in 1966) had a verbal altercation with Wang (born in 1944) playing cards in the community recreation room, and then Zhang injured Wang's head with his fist, and Wang was sent to the hospital for hospitalization after being injured, spending more than 1,600 yuan in medical expenses.
The Wangou Forest Public Security Bureau imposed an administrative penalty of a fine of 100 yuan on Zhang. Afterwards, the two parties failed to negotiate on medical expenses compensation and other matters, so Wang filed a lawsuit with the Wangou People's Court, demanding that Zhang compensate for various losses of 3,400 yuan.
In view of the advanced age of the parties, and the fact that they live in the same community and have a fixed living environment, if the dispute between the parties cannot be completely resolved, it may lead to the deepening of the grievances and affect the families of both parties, so the presiding judge went to the homes of the parties to carry out pre-litigation mediation.
Mediation process
At the beginning of the mediation, Wang said:
"The court can't handle such a small matter, what else can it do?"
And Zhang said:
"My family has no money, you can compensate me to him!"
While actively calming the emotions of both parties, the judge guided them to empathize, contacted the children and relatives of both parties to jointly conduct psychological counseling, and explained the law and reasoning from the perspectives of legal provisions, litigation costs, and legal liability, so as to promote both parties to deal with disputes rationally.
In this way, after the judge went back and forth to the homes of both parties for "back-to-back" mediation more than 10 times, the two parties also changed their mentality, from the initial incomprehension and non-cooperation to "Thank you, judge, for bothering you." "I really shouldn't have beaten him, and he's so old, I'm afraid!"
In the end, Zhang took the initiative to go to Wang's house to apologize and pay Wang 2,000 yuan on the spot, and the two sides shook hands and made peace.
