In order to further strengthen and standardize the statistical work of the agricultural and rural departments, improve the quality of statistical data, and give full play to the important role of statistics in serving the comprehensive promotion of rural revitalization and accelerating the construction of an agricultural power, the Ministry of Agriculture and Rural Affairs formulated the "Administrative Measures for the Statistical Work of the Agricultural and Rural Departments", which was recently promulgated and will come into force on July 1, 2024.

Measures for the Administration of Statistical Work in Agricultural and Rural Departments

Chapter I: General Provisions

Article 1: These Measures are formulated on the basis of the "Statistics Law of the People's Republic of China" and the "Regulations for the Implementation of the Statistics Law of the People's Republic of China" in order to further strengthen and standardize statistical work in the agricultural and rural sectors, improve the quality of statistical data, and give play to the important role of statistics in serving the comprehensive promotion of rural revitalization and accelerating the construction of an agricultural power.

Article 2 The competent departments of agriculture and rural affairs at all levels shall conduct statistical surveys and statistical analysis on the development of agricultural industries, rural development and construction, and the production and living of farmers, provide statistical data, and implement statistical supervision, and these measures shall apply.

Article 3 The Ministry of Agriculture and Rural Affairs is responsible for the macro guidance, overall coordination, organization and implementation, supervision and management of the statistical work of the national agricultural and rural departments.

Local departments in charge of agriculture and rural affairs at all levels shall, under the guidance of the competent departments of agriculture and rural affairs at higher levels, be responsible for the statistical work of agricultural and rural departments within their respective administrative regions.

Article 4: The competent departments for agriculture and rural affairs at all levels shall strengthen the organization and leadership of statistical work, clarify the institutions and personnel undertaking statistical tasks, and provide necessary funding and conditions for carrying out statistical work in accordance with law.

Article 5: All levels of competent departments for agriculture and rural affairs shall strengthen the establishment of statistical informatization, accelerate the application of big data in agriculture and rural areas, and actively use information technology to advance the modernization of statistical work in agricultural and rural departments.

Article 6: State organs, enterprises, public institutions, and other organizations, as well as individual businesses and individuals, and other subjects of statistical surveys, shall provide the materials required for statistical surveys in a true, accurate, complete, and timely manner in accordance with law, and must not provide untrue or incomplete statistical materials, and must not delay, conceal, or refuse to report.

Article 7: The competent departments for agriculture and rural affairs at all levels shall strictly implement the responsibility system for preventing and punishing statistical fraud and fraud, actively assist the statistical agencies of the people's governments at the same level in investigating and handling statistical violations, and promptly transfer relevant statistical violation case materials in accordance with provisions.

Chapter II: Statistical Surveys

Article 8: Where the competent departments of agriculture and rural affairs at all levels implement laws, regulations, rules and decisions of the people's governments at the same level and perform their duties and perform their duties, and need to carry out statistical activities, they shall formulate corresponding statistical survey projects.

Survey items include:

(1) Comprehensive statistical survey projects refer to statistical survey projects involving the overall development of agriculture, rural areas and rural areas;

(2) "Professional statistical survey projects" refers to statistical survey projects involving a certain industry, a certain field, or a certain work in agriculture and rural areas.

Article 9 The statistical survey projects formulated by the Ministry of Agriculture and Rural Affairs shall be proposed by the relevant departments and bureaus of the Ministry of Agriculture and Rural Affairs and dispatched agencies on the basis of full argumentation, solicitation of opinions, and collective discussion and decision, and shall be submitted to the National Bureau of Statistics for examination and approval or filing in accordance with the procedures after being reviewed by the centralized management department of statistical work.

Statistical survey projects formulated by local departments in charge of agriculture and rural affairs at all levels shall be submitted to statistical agencies for examination and approval in accordance with law, and their main contents shall not duplicate or contradict the content of statistical survey projects formulated by the Ministry of Agriculture and Rural Affairs.

The effective time of a statistical survey project shall be the date on which the statistical agency approves the implementation or agrees to the filing. Where it is necessary to change the content of a statistical survey item during the validity period, it shall be re-examined and approved or filed in accordance with procedures.

Article 10 The competent departments of agriculture and rural affairs at all levels shall formulate a statistical survey system for the project at the same time.

The content of the statistical survey system includes a general description, a table of contents, a questionnaire format, a classification catalog, an explanation of indicators, and a logical relationship between indicators.

The general description of the statistical survey system shall make provisions on the purpose of the survey, the object of the survey, the scope of statistics, the content of the survey, the frequency of the survey, the time of the survey, the method of the survey, the method of organization and implementation, the quality control, the requirements for submission, the sharing of information, the publication of materials, etc.

For unit-oriented departmental statistical surveys, the subjects of the statistical survey shall be taken from the national directory of basic units or the directory of departmental basic units.

Article 11 The statistical questionnaire shall be marked with the form number, the formulating organ, the approval or filing number, the validity period, etc. The indicators in the questionnaire should have clear definitions and sources of data collection.

12th agricultural and rural sector statistical surveys shall reasonably determine the frequency and scale of the survey, comprehensive use of comprehensive surveys, sample surveys, key surveys and other methods, and make full use of administrative records and other information.

The competent departments of agriculture and rural affairs at all levels may carry out statistical surveys through government procurement of services and other means, and are responsible for the process and results of statistical surveys. Entities undertaking government procurement of services shall carry out statistical survey work in strict accordance with the statistical survey system.

13th local departments in charge of agriculture and rural affairs at all levels shall strictly implement the statistical survey system, strengthen the quality control of the whole process of data collection, transmission, review, summary, accounting, analysis and other links, and report statistical data in a timely and accurate manner.

Article 14 Statistical surveys in the agricultural and rural sectors shall be based on national statistical standards. Where there are no national statistical standards, the Ministry of Agriculture and Rural Affairs may formulate departmental statistical standards and submit them for approval in accordance with the procedures stipulated in the Statistics Law of the People's Republic of China.

Chapter III: Management of Statistical Data

Article 15: The competent departments of agriculture and rural affairs at all levels shall establish and improve the management system for the preservation of statistical data, standardize the collation, identification, handover, archiving, maintenance, borrowing and other work of statistical data, and promote electronic management.

Article 16: The competent departments of agriculture and rural affairs at all levels shall establish and improve mechanisms for sharing statistical information, and promptly share statistical information with the statistical agencies of the people's governments at the corresponding levels in accordance with law.

Article 17: The competent departments for agriculture and rural affairs at all levels shall strengthen the application of statistical data in areas such as the development of agricultural industries, the governance of rural development and construction, and the production and livelihood of farmers, and publish data in accordance with the provisions of the statistical survey system.

Article 18: The competent departments for agriculture and rural affairs at all levels and their statisticians shall keep confidential state secrets, work secrets, commercial secrets, and personal information that they learn of in the course of statistical work, and must not disclose or illegally provide them to others.

All levels of competent department for agriculture and rural affairs shall strengthen data security management, scientifically assess the risks formed by data aggregation, increase technical means for data security, and prevent data leaks.

Chapter IV Statistical Institutions and Statisticians

Article 19 The Department of Centralized Management of Statistics of the Ministry of Agriculture and Rural Affairs shall perform the following duties:

(1) Organize the formulation of statistical system specifications and departmental statistical standards for agricultural and rural departments, establish and improve the statistical system for agricultural and rural departments, and specifically undertake the supervision and management of statistical work in agricultural and rural departments nationwide;

(B) unified deployment and review submitted to the Ministry of Agriculture and Rural Affairs statistical survey projects;

(3) Organize the implementation of the comprehensive statistical survey project of the Ministry of Agriculture and Rural Affairs, and supervise and inspect the implementation of the comprehensive statistical survey system;

(4) Guide the relevant departments and dispatched agencies to implement the professional statistical survey projects of the Ministry of Agriculture and Rural Affairs;

(E) the overall management of the Ministry of Agriculture and Rural Affairs statistical data summary, sharing and publication, the preparation of annual statistical bulletins and comprehensive statistical data, the establishment and improvement of statistical indicators and databases;

(6) Coordinate and promote the construction of statistical informatization and the development of big data in the agricultural and rural sectors;

(7) Organize and guide professional training and professional ethics education for statisticians in agricultural and rural departments.

Article 20 The relevant departments and bureaus of the Ministry of Agriculture and Rural Affairs shall perform the following duties:

(1) Organize and implement professional statistical survey projects within the scope of business, and supervise and inspect the implementation of the professional statistical survey system;

(2) Formulate statistical management systems for their respective industries and fields, and participate in the formulation of statistical standards for agricultural and rural departments;

(3) Optimize and improve the statistical indicator system, and strengthen the collection, collation, summarization, review, sharing, analysis, and application of statistical data;

(4) Submit the annual statistical data publication plan to the centralized management department of statistical work, and publish it as required;

(5) Promote the construction of statistical informatization and the development of big data in the industry and field;

(6) Strengthen oversight and management of relevant public institutions and scientific research institutions entrusted with statistical work;

(7) Responsible for the management and training of statisticians in their respective industries and fields.

Article 21 Local departments in charge of agriculture and rural affairs at all levels shall perform the following duties:

(A) in accordance with the Ministry of Agriculture and Rural Affairs statistical survey project and its statistical survey system requirements, responsible for the collection, sorting, summarization, review, submission of statistical data in the administrative region;

(B) the development and implementation of local agricultural and rural sector statistical survey projects and statistical survey systems;

(3) Carrying out statistical data analysis and judgment, and providing statistical information services;

(4) Promote the construction of statistical informatization and the development of big data in the agricultural and rural sectors within their respective administrative regions;

(E) to supervise and manage the statistical work of the agricultural and rural departments within the administrative area;

(6) Responsible for the management and training of statisticians within their respective administrative regions.

Article 22 The competent departments of agriculture and rural affairs at all levels and their statisticians shall perform their duties in accordance with the law, truthfully collect and submit statistical data, shall not falsify or tamper with statistical data, shall not require any unit or individual to provide untrue statistical data in any way, and shall not have other acts in violation of the provisions of the Statistics Law of the People's Republic of China.

When conducting statistical surveys, statisticians have the right to ask relevant personnel on issues related to statistics, and require them to truthfully provide relevant information and information, and to correct untrue and inaccurate information.

When statisticians conduct statistical surveys, they shall present their work certificates issued by their departments; If it is not presented, the subject of the survey has the right to refuse the investigation.

Article 23: Statisticians shall possess professional knowledge and professional ability appropriate to the statistical work they are engaged in, persist in seeking truth from facts, abide by professional ethics, and be responsible for the consistency of the statistical data they are responsible for collecting, reviewing, and entering with the statistical data submitted by the subjects of statistical investigations.

Chapter V: Supervision and Management

24th agricultural and rural departments at all levels and their staff in violation of the provisions of these measures, in accordance with the People's Republic of China Statistics Law, the People's Republic of China Statistics Law Implementation Regulations shall be dealt with.

Article 25 Where a State organ, enterprise, public institution or other organization that is the subject of a statistical survey in the agricultural and rural sector commits any of the following acts, it shall be transferred to the relevant institution for investigation and punishment in accordance with the "Statistics Law of the People's Republic of China":

(1) Refusing to provide statistical materials or failing to provide statistical materials on time after being reminded;

(2) Providing untrue or incomplete statistical materials;

(3) Refusing or obstructing statistical investigations or inspections;

(4) Transferring, concealing, altering, destroying, or refusing to provide original records and vouchers, statistical ledgers, statistical questionnaires, and other relevant proofs and materials;

(5) Late reporting of statistical materials;

(6) Failure to set up original records and statistical ledgers in accordance with relevant state provisions.

Where individual industrial and commercial households have any of the acts listed in items (1) to (5) of the preceding paragraph, they shall be transferred to the relevant institutions for investigation and punishment in accordance with the "Statistics Law of the People's Republic of China".

Article 26: Higher-level departments in charge of agriculture and rural affairs may, on the basis of these Measures, supervise the implementation of statistical laws, regulations and systems by lower-level departments in charge of agriculture and rural affairs, carry out statistical operations, implement a responsibility system for preventing and punishing statistical fraud and fraud, and ensure personnel strength and working conditions.

The competent departments of agriculture and rural affairs at all levels shall give circulars and commendations to units and personnel who have fulfilled their duties and made outstanding contributions in statistical work, and shall circulate criticisms for those who fail to perform their duties in a timely manner or have poor data quality.

Where there are serious problems in the implementation of statistical survey tasks assigned by the competent departments for agriculture and rural affairs at the higher level, the competent departments for agriculture and rural affairs at the higher level shall give them a talk.

Chapter VI Supplementary Provisions

Article 27: These Measures take effect on July 1, 2024.
